Welcome to Tail Wags Treasure! Please read these Terms & Conditions (“Terms”) carefully before using our website (the “Service”) operated by Tail Wags Treasure (“us”, “we”, or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Introduction

These Terms apply to all visitors, users, and others who access or use the Service. By accessing or using the Service, you agree to be bound by these Terms.

2. Accounts

When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorised use of your account.

3. Subscription Service

By subscribing to Tail Wags Treasure, you agree to pay the subscription fee indicated for the service level you have selected. Subscription payments will be charged on a recurring basis as per the chosen plan (monthly, quarterly, or annually).

Minimum Commitment: Subscriptions require a minimum commitment of 3 months. You cannot cancel your subscription during the initial 3-month period.

After the initial 3-month period, you can cancel your subscription at any time by accessing your account settings. Cancellation will take effect at the end of the current billing period. No refunds will be issued for the remaining period of a subscription.

4. Pre-Order Service

Pre-orders for Tail Wags Treasure boxes are available starting from 12th August 2024. When you place a pre-order, you agree to pay a 10% discounted rate for the first box. The pre-order payment will be processed immediately upon placing the order. The official launch and delivery of pre-ordered boxes will commence on 1st September 2024.

5. Payment and Billing Information

All payment information provided must be accurate and complete. By submitting such information, you authorise us to charge all subscription fees incurred through your account to the payment method you provided.

We use Stripe for processing payments. By using our Service, you agree to comply with Stripe’s Terms of Service and Privacy Policy.

6. Delivery and Shipping

Subscription boxes will be delivered monthly to the address provided during the subscription process. Delivery costs are included in the subscription fee for the Tail-Wagging Fun Box and Ultimate Pup Paradise plans. The Paw-some Starter Box incurs an additional delivery fee.

We are not responsible for any delays in delivery caused by postal services or unforeseen circumstances. If you experience issues with delivery, please contact us at support@tailwagstreasure.co.uk.

7. Returns and Refunds

Due to the personalised nature of our products, we do not accept returns or offer refunds on subscription boxes, except as required by law. For full details, including your rights under UK consumer law, please refer to our Refunds & Returns Policy. If you receive a damaged or defective item, please contact us within 14 days of receiving your box at support@tailwagstreasure.co.uk, and we will arrange a replacement or provide a refund in accordance with our policy.

8. Privacy Policy

Our Privacy Policy, which sets out how we will use your information, can be found at [Privacy Policy Link]. By using this Service, you consent to the processing described therein and warrant that all data provided by you is accurate.

9. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Tail Wags Treasure and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Tail Wags Treasure.

10. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.

Tail Wags Treasure Competition Terms and Conditions

1. Promoter:

The promoter of this competition is Tail Wags Treasure (the “Promoter”).

2. Eligibility

• The competition is open to residents of the UK who are aged 18 years or over.
• Employees of Tail Wags Treasure and anyone directly connected with the competition are not eligible to participate.

3. Entry Period:

• The competition opens on 1st September 2024 and closes at 11:59 PM on 22nd September 2024.
• Entries submitted after the closing date will not be considered.

4. How to Enter:

To enter the competition, participants must:

1️⃣ Like the competition post on Facebook or Instagram.

2️⃣ Follow on either Facebook or Instagram:

• Facebook: https://www.facebook.com/tailwagstreasure

3️⃣ Tag a fellow dog lover in the comments. (Each tag equals one entry. Participants can enter multiple times by tagging different friends, but each comment must include only one tag.)

5. Prize:

• The winner will receive one free Tail Wags Treasure subscription box, valued at £35.
• The prize is non-transferable, non-exchangeable, and cannot be redeemed for cash or other alternatives.

6. Winner Selection:

• The winner will be selected at random from all valid entries received during the entry period.
• The winner will be notified via direct message on Facebook or Instagram within 5 business days after the competition closes.

7. Claiming the Prize:

The winner must respond to the notification within 48 hours to claim the prize. If the winner does not respond within this time frame, the Promoter reserves the right to select a new winner.

8. Use of Entries:

By entering, participants agree to allow Tail Wags Treasure to share or repost their tagged comments or content related to the competition.

9. Disqualification:

The Promoter reserves the right to disqualify any entry that it deems inappropriate or not in compliance with these Terms and Conditions.

10. Changes to the Competition:

The Promoter reserves the right to cancel, modify, or suspend the competition in the event of unforeseen circumstances.

11. Liability:

The Promoter is not responsible for any entries not received due to technical issues or for any incorrect or inaccurate information supplied to the Promoter during the competition.

12. Personal Data:

Any personal data relating to participants will be used solely in accordance with the UK’s data protection legislation and will not be disclosed to a third party without the entrant’s prior consent.

13. Disclaimer:

This competition is in no way sponsored, endorsed, or administered by, or associated with, Facebook or Instagram. Participants understand that they are providing their information to the Promoter and not to Facebook or Instagram.

14. Governing Law:

The competition and these Terms and Conditions are governed by the laws of England and Wales.
